Merchant Wallet

The business with whom you have an account relationship to make purchases of goods and services (the “Merchant”) from the Merchant’s mobile application, website, store, or other location (the “Merchant Platform”) is making a digital wallet (the “Merchant Wallet”) available to you in partnership with Get Ansa, Inc. (“Program Manager") and Program Manager’s partner bank, First Internet Bank of Indiana, Member FDIC (“Bank”). Your Merchant Wallet allows you or the Merchant to load U.S. dollar value into Merchant’s account at Bank to create your Merchant Wallet balance (“Merchant Cash”) for use on the Merchant Platform. The Merchant Cash that you load into the Merchant Wallet is a prepayment for the goods and services from the Merchant Platform. Unless otherwise required by law, by the Merchant, or as permitted by this Ansa End User License Agreement (these “Terms”), the Merchant Cash you add to your Merchant Wallet is nonrefundable and may not be redeemed for cash. Your Merchant Wallet balance is accessible to you through the Merchant Platform. You do not earn interest on your Merchant Cash. The Merchant Wallet is not targeted towards, nor intended for use by, anyone under the age of 18.

Loading Value into Your Merchant Wallet

Unless you have verified your identity with the Merchant (a “Verified User”), you may not have more than $2,000 in value in your Merchant Wallet balance at any time, and you may not add more than $2,000 to your Merchant Wallet balance in a single day. This also means that your activity on the Merchant Wallet cannot exceed $2,000 over the course of a day. There is a minimum amount that you may load into your Merchant Wallet balance at any given time, and that amount is typically $1. Maximum Merchant Wallet amounts for Verified Users are determined in the Merchant’s sole discretion and can be found through the Merchant Platform. See the Merchant Platform for instructions on how to become a Verified User. Merchant may change any of these amounts at any time without notice to you.

If your transaction is canceled, Merchant will request an authorization reversal on your behalf. Reversal times may vary. Merchant recommends contacting your bank or credit card company to learn about their authorization and authorization reversal policies.

If your Merchant offers the opportunity to auto-refill your Merchant Wallet with Merchant Cash, you may opt to have your payment method automatically charged whenever your Merchant Wallet balance is running low. With auto-refill, your payment method will be charged the amount you selected every time your Merchant Wallet balance drops below $10. Loading Merchant Cash via auto-refill to your Merchant Wallet, and associated charges to your payment method, are not refundable or revocable except where required by law. You can choose to turn off the auto-refill feature any time before the next charge from the Merchant Platform menu, but the auto-refill charge amount you selected will continue unless and until you elect to turn them off.

Merchant Cash loaded into your Merchant Wallet balance is denominated in U.S. dollars or in another currency supported by the Merchant. Availability of other currencies is detailed in the Merchant Platform.

Fees and Expiration of Merchant Wallets

Merchant does not charge any activation, service, dormancy, or inactivity fees in connection with your Merchant Wallet. Your Merchant Wallet has no expiration date, and except for funds credited to your Merchant Wallet by the Merchant in connection with a promotion that you fail to redeem, claim, or use,  your Merchant Cash balance never expires.

Receipts and Transaction History

When you use your Merchant Wallet, Merchant will provide a receipt if you request one. Please check your online transaction history, including your reload transaction history, regularly to ensure that your transaction history and Merchant Wallet balance are correct. You can check the balance of your Merchant Wallet and review recent transactions, including reload transactions, on your Merchant Platform. Merchant will not send you statements of activity on your Merchant Wallet.

Billing Errors, Corrections

Merchant will correct the balance of your Merchant Wallet if Merchant believes that a clerical, billing, or accounting error occurred. If you have questions regarding your transaction history or any correction, or if you wish to dispute any transaction or correction that has been applied to your Merchant Wallet, please contact the Merchant directly. Assuming you provide sufficient details, Merchant will review your claim and tell you the results of the review. Merchant will correct any error promptly after the review is completed. If Merchant does not find any error, Merchant will explain what was found. Merchant has no obligation to review or correct any billing error unless you provide sufficient notice for Merchant to review your claim within sixty (60) days of the date of the transaction in question.

Fraud Associated with Your Merchant Wallet

Merchant will limit use of your Merchant Wallet or your Merchant Wallet balance, if Merchant reasonably believes that the use is unauthorized, fraudulent or otherwise unlawful, and Merchant considers such action appropriate to limit its risk.  Merchant has no liability to you for any third-party fraud or unlawful activity associated with any Merchant Wallet balance. If Merchant suspects or discovers any Merchant Wallet balance was sourced or derived from fraud or other unlawful means, Merchant may in its sole discretion, cancel all impacted Accounts and retain all related Merchant Wallet balances without notice to you. Merchant may use retained Merchant Wallet balances to help offset its liability to card companies, networks, and issuers of lost or stolen credit and debit cards used to load Merchant Wallets.

Liability for Unauthorized Transactions

You should treat your Merchant Wallet like cash and not disclose your Merchant Platform login credentials to anyone. If your Merchant Platform login credentials are lost or stolen, unauthorized persons may be able use your Merchant Wallet balance. You are responsible for all transactions on your Merchant Wallet, including unauthorized transactions. If your Merchant Platform login credentials become lost or stolen, report it as soon as possible by contacting the Merchant directly. Your Merchant Wallet balance is protected from the time you notify Merchant. Merchant will freeze your remaining Merchant Wallet balance at the time you notify Merchant and will reload that remaining Merchant Wallet balance into your Merchant Wallet once you have secured your Account.

Cancellation

If your Account is canceled, terminated, or otherwise closed, your Merchant Wallet will also be closed. If Merchant terminates your Account without cause, Merchant will refund or issue store credits equal to your Merchant Wallet balance, less any amounts that you may owe Merchant. If Merchant terminates your Account for cause, Merchant may, if Merchant deems it appropriate to limit Merchant’s losses, retain any Merchant Wallet balances in your canceled Account. If you cancel your Account with Merchant, any Merchant Wallet balance will be nonrefundable unless Merchant is required to issue a refund per applicable law, or if Merchant chooses to do so in its sole discretion. Merchant Wallets that remain inactive for more than 6 months (or such other period specified by the Merchant) may be subject to cancellation at Merchant’s discretion. All refunds will be transferred or credited to the original payment method used to load the Merchant Wallet. Once your Merchant Wallet is canceled (whether by you or by Merchant), you will no longer be able to access your Merchant Wallet or your Merchant Cash. Merchant will not be liable to you or to any third party for the suspension or cancellation of your Merchant Wallet, or your access to or use of the Merchant Wallet. Once your Merchant Wallet is canceled, you understand and acknowledge that Merchant will have no further obligation to provide access to your Merchant Wallet or your Merchant Cash or allow you to access to any of your Merchant Wallet information. If you wish to reactivate your Merchant Wallet, please contact Merchant directly. If you are unable to reactivate your Merchant Wallet, you will need to create another Account to use the Merchant Wallet. Please note that certain states require that Merchants turn unclaimed funds over to the state. This may happen if your Merchant Wallet remains canceled for a long time. If this happens to your Merchant Wallet balance, you will need to contact the relevant state to reclaim your funds.

Merchant Card

Merchant may provide you a virtual and physical card (the “Card”) that you can use at Merchant locations to access the Merchant Cash in your Merchant Wallet to make purchases. The Card is issued to Merchant by Bank, not to you, and is provided to you as a convenience. Neither Program Manager nor Bank have any obligation to you whatsoever regarding the Card. The Card is branded with the Mastercard logo, which means you can swipe it at a Merchant location in the same way you would use a credit or debit card. The Card is linked to your Account and must be activated through the Merchant App before you can use it. You may only use your Card to make purchases from Merchant. Your Card is the property of Merchant and you must return it upon request.

Your use of the Card to make purchases from Merchant is subject to the same conditions and limitations that apply to your Merchant Wallet set forth above.

Your Card will not have your name on the front, but you are liable for all activity on the Card. If your Card is lost or stolen, contact the Merchant immediately through the Merchant App to deactivate the Card. You could lose all of the Merchant Cash in your Merchant Wallet if you fail to do so. You can still use your Merchant App to make purchases even if your Card has been deactivated.

If you or Merchant closes your Account, the Card will automatically terminate and you will no longer be able to make purchases with it. Merchant may cancel, revoke, repossess or restrict the use of your Card at any time. Merchant may decline to authorize or reverse transactions or suspend your Card for any reason. Not all Merchant locations accept Cards. Merchant is not responsible and will have no liability if a Merchant location refuses to honor your Card.
